A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    On or about August 22, 2012, at the above addressed jobsite, an employee was installing a water main in a trench six (6) feet eight (8) inches in depth that did not have a safe means of egress.    There is no abatement certification or documentation required for this item.

29 CFR 1926.652(a)(1):  Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    On or about August 22, 2012, at the above addressed jobsite, an employee was installing a water main in a trench measured at six (6) feet eight (8) inches in depth.  The trench was not protected against cave in, thereby exposing the employee to the hazards associated with cave ins.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
