29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure: On August 23, 2012, on the north side of the construction, employees were framing on the flat roof of a residential building while working at a height of approximately 9 feet from the ground, without any form of fall protection.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program did not enable each employee to recognize the hazards of falling and did not train each employee in the procedures to be followed in order to minimize these hazards: On August 23, 2012, employees were framing a residential construction, working at a height of approximately 9 feet, without having been provided a training program to recognize the hazards of working at this height without fall protection.
