OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible dust fire and explosion hazards:      A.  Prime Vertical Band Saw Work Area:  On or about August 22, 2012, employees were exposed to fire and/or explosion hazards because the combustible dust generated by band saw operations was collected through a dust collection system that had no protective measures to detect, suppress, isolate and/or contain combustible fires and/or explosions that were at risk of occurring in or entering the work area.      Note:  The dust collection system had a corrugated plastic hose duct leading to a Cincinnati Fan Model S100, which moved the combustible dust into an indoor enclosureless collector with a dirty-side volume exceeding 8 cubic feet, located in the same work area.      B.  Main Plant:  On or about August 22, 2012, employees were exposed to fire and/or explosion hazards because the combustible dust generated by the corrugated converting process traveled through a Classifier system that included a dust collection system with no protective measures to prevent, detect, suppress, isolate and/or contain combustible fires and/or explosions that were at risk of occurring in or entering the work area.      Note:  The dust collection system included collection hoods, ducts, blowers, material separator, baler, air-material separator, filtered air discharge duct, and exhaust return air system.

29 CFR 1910.22(a)(1):  All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition:    On, or about, August 22, 2012, the employer had not developed and implemented adequate housekeeping procedures to minimize the accumulation of combustible corrugated dust in the following areas:    A.  Prime Band Saw work area:  Combustible corrugated dust had accumulated on the wall, wall ledge, pipes, structural building members, equipment, duct work and stack of corrugated stock.    B.  Classifier Area:  Combustible corrugated dust had accumulated on the Classifier platform, equipment, flanges, duct work, machines and electrical boxes.

29 CFR 1910.212(a)(1):  Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by rotating parts and in-running nip points    In the following locations, machinery was not provided with adequate safeguarding:    A.  Production Area:    1.  Machine 135, McKinley serial number 23098:  On, or about, August 22, 2012, an emergency stop device was not provided on the side of the lift table where in-running nip points were created by the conveyor belt.  Also, employees stood on free-wheeling roller conveyor rollers while adjusting the stacker section of the lift table.      2.  Machine 134, HYCORR:  On, or about, August 22, 2012, the machine was provided with only one emergency stop device located at the rear of the machine on the working side near the stacker.  Each of the other three stop buttons were spring-loaded and could be over-ridden by other machine controls once released.      3.  Machine 140, 38 inch Curioni Flexo:  On, or about, August 23, 2012, an emergency stop device was not provided at the center of the take-away belt section  where the conveyors created accessible in-running nip points.  Also, similar looking stop buttons were not labeled to indicate what devices were intended to be used as emergency stop devices.    4.  Machine 145, 28 inch Curioni Flexo:  On, or about, August 23, 2012, the belt section after the stacker section of the machine was not provided with an emergency stop device where conveyors created accessible in-running nip points.    5.  Machine 141, 28 inch Curioni Flexo:  On, or about, August 23, 2012, the belt section after the stacker section of the machine was not provided with an emergency stop device where conveyors created accessible in-running nip points.  Also, this machine had non-standard symbols to identify the function of the buttons on the machine.  There were several red buttons that could be mistaken as emergency stop devices which were not and the actual emergency stop buttons were recessed.        B.  Stitching Area:  On, or about, August 23, 2012, the rotating shaft and rubber rollers provided at the back of the Bostitch Stitcher to pull stock through the stitching head were exposed.
