29 CFR 1910.147(c)(1):     Energy control program. The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    On or about August 15, 2012, and at times prior thereto, the employer did not develop a written energy control (lockout/tagout) program to include, but not limited to, an energy control procedure, employee training, and periodic inspection of the specific written lockout/tagout procedures exposing employees to the hazards of being caught in machinery.

29 CFR 1910.147(c)(4)(i):     Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.     The employer did not develop specific written lockout/tagout procedures for the control of potentially hazardous energy when performing servicing and/or maintenance activities for the following:    a)	This violation occurred on or about August 15, 2012, and at times prior thereto, for employees required to change the dies on the ironworker exposing employees to the hazards of being caught in the machinery      b)	This violation occurred on or about August 15, 2012, and at times prior thereto, for employees required to change drill bits on the west Carlton drill press exposing employees to the hazards of being caught in the machinery.        c)	This violation occurred on or about August 15, 2012, and at tims prior thereto, for employees required to change drill bits on the east Carlton drill press exposing employees to the hazards of being caught in the machinery.

29 CFR 1910.147(c)(7)(i):     The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:    On or about August 15, 2012, the employer did provide adequate training to employees who perform servicing and maintenance operations such as, but not limited to changing dies on the ironworker and changing drill bits on the east and west Carlton drill presses exposing employees to the hazards of being caught in the machinery.

29 CFR 1910.134(c)(2)(ii):     The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user.     On or about August 15, 2012, the employer did not develop a written respiratory protection program, to include at a minimum, the requirement for a medical evaluation and the procedures for cleaning, storing and maintaining the respirator for employees who voluntarily were wearing the N95 particulate respirator and the North elastomeric respirator.
