29 CFR 1926.300(b)(1): When power operated tools were designed to accommodate guards, they were not equipped with such guards when in use: Near the middle of the interior of the building: On or about August 28, 2012, and at times prior thereto, there was no guard on the chop saws abrasive wheel that was used to cut rebar. The chop saw was designed to have a guard for the wheel that retracted when the chop saws head was lowered to cut the rebar. The guard protects employees from being struck by the fragments of the abrasive wheel in the event of wheel breakage.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: At the backside of the building: On or about August 28, 2012, eye and hand protection was not worn while plastering a window opening with Portland cement.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables shall not be used: Near the middle of the interior of the building: On or about August 28, 2012, and at times prior thereto, the electrical cord to the 110 VAC chop saw was frayed. The saw was used to cut rebar.
