29 CFR 1926.25(a):     During the course of construction, alteration, or repairs,  debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:      a) On or about 8/28/12 on roof of Bldg. #1, Maryner Tower Apartments, 186 Efner St., Buffalo, NY: The west end of the roof between the structure housing the boiler & elevator shaft, was used as a storage area for roofing materials, equipment, & supplies. The area also contained a hoisting area for unloading materials from a crane, as well as a porta-potti. The area was cluttered with debris including but not limited to old torn off roofing, scraps of insulation board, used  plastic wrapping, broken concrete blocks, cardboard boxes, circular cardboard tubes etc.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(b)(1)(i):     Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites.      a) On or about 8/28/12 on roof of Bldg. #1, Maryner Tower Apartments, 186 Efner St., Buffalo, NY: An employee used both a Kobalt Circular Saw and a Bosch sawzall to cut insulation board. The saws were connected to 120-volt ac power via an extension cord which was plugged into a wall receptacle in the elevator room of the building. No GFCI or assured equipment grounding program was being used.    NO ABATEMENT CERTIFICATION REQUIRED

Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.    a) On or about 8/28/12 on roof of Bldg. #1, Maryner Tower Apartments, 186 Efner St., Buffalo, NY: Employees installing an EPDM Rubber Roofing System on the north side of the flat roof were exposed to a fall of approx. 80 ft. off the roof edge on the north side and also on the northwest & northeast edges of the roof. All of the employees were wearing a full body harness, but none were "tied off" to anything, and no other fall protection system was utilized.    NO ABATEMENT CERTIFICATION REQUIRED

Additioally, there was no delineation between the hoist area and the material storage area on the west side of the roof and employees in this area were also exposed to a potential fall of approx. 80 feet from the west edge of the roof. This work included but was not limited to working in a hoisting area where employees signaled a crane operator to land loads of materials, unhooked the load, and moved the material to storage areas; used mechanical equipment such as a Sweeper & a "Roof Warrior" to tear off the old roof; and installed an EPDM Rubber Roofing System. Training about the Osha fall protection requirements and the appropriate fall protection measures to be utilized while doing different tasks on different parts of the roof was not provided. 29 CFR 1926.405(a)(2)(ii)(I):     Protection was not provided to avoid damage to flexible cords and cables used for temporary wiring which passed through doorways or other pinch points:      a) On or about 8/28/12 on roof of Bldg. #1, Maryner Tower Apartments, 186 Efner St., Buffalo, NY: A Circular Saw and a Bosch sawzall were connected to 120-volt ac power via an extension cord which was plugged into a wall receptacle in the elevator room of the building. The extension cord ran under the elevator room door and then thru the west exit door from the stairway to the roof. The exit door was closed onto the cord causing a cut in the outer sheath of the cord.    NO ABATEMENT CERTIFICATION REQUIRED
