29 CFR 1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) 18 Elmora Avenue, Elizabeth, NJ - Ground level dumpster area - Employees working in close proximity to overhead roofing activities were not wearing head protection.    Condition observed on or about August 31, 2012.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented.    a) 18 Elmora Avenue, Elizabeth, NJ: Employees were observed removing shingles on a 12/12 pitched roof with an eave in excess of 22' to the ground below with no fall protection in place exposing them to fall hazards.    Condition observed on or about August 31, 2012.

29 CFR 1926.503(c): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section:    a) 18 Elmora Avenue, Elizabeth, NJ: Employee observed wearing fall protection on a 12/12 pitched roof with an eave in excess of 22" to the ground level was observed wearing a fall protection harness inside out and was not attached to an anchoring device.    Condition observed on or about August 31, 2012.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet above the upper surface to which the ladder was used to gain access.    a) 18 Elmora Avenue, Elizabeth, NJ: The ladder provided was not secured and did not extend 3 feet above the working surface of the roof to allow for safe access on and off the roof.    Condition observed on or about August 31, 2012.
