29 CFR 1910.157(d)(1):     Portable fire extinguishers were not selected based on the classes of anticipated workplace fires and on the size and degree of hazard that would affect their use:      On or about August 31, 2012, and at times prior thereto, at the facility the employees were required to handle recycled flammable metals without Class D fire extinguishers provided.  Employees were exposed to fire and smoke inhalation.

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:      On or about August 31, 2012, and at times prior thereto, at the establishment the employer did not complete a written hazard communication program to describe how the company would meet the requirements of employee training, gathering MSD sheets and labeling containers.  Employees were exposed to possible physical and/or health hazards due to exposed to various hazardous materials.
