29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a. On or about August 2, 2012, in the facility, employees were required to operate mechanical equipment on a daily basis. Sufficient safe clearance with dry floors was not provided for all aisles and passageways thereby exposing employees to being struck by materials when navigating mechanical handling equipment.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. On or about August 2, 2012, in the facility, employees were required to operate powered industrial vehicles on a daily basis. The employer had not provided formal and practical training on the safe operation of powered industrial vehicles thereby exposing employees to struck by and crushing hazards.
