29 CFR 1926.600(a)(3)(i): Bulldozer and scraper blades, end-loader buckets, dump bodies, and similar equipment, were not either fully lowered or blocked when being repaired or when not in use: Near the south end of the project on or about September6, 2012, the stabilizers were not lowered to the ground on a Caterpillar 430 E backhoe. The backhoe was not running, and the operator was more than 25 feet away. The backhoe was used to move soil around the site.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage that could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. All defects were not corrected before the vehicle is placed in service. These requirements also apply to equipment such as lights, reflectors, windshield wipers, defrosters, fire extinguishers, etc., where such equipment was necessary: Near the south end of the project on or about September6, 2012, all defects were not corrected on a Caterpillar 430 E backhoe before it was placed in service as the front right tire was cut or cracked down to the belts. The backhoe was used to move soil around the site.
