29 CFR 1910.106(b)(6): In locations where flammable vapors may be present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition. Sources of ignition may include open flames, lightning, smoking, cutting and welding, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat: (a) At Rig #16 near Stanley, ND, where, on or about 09/04/2012, employees were exposed to the potential for injury and/or death when flammable vapors were ignited inside the invert mud tank creating an explosion and fire.

29 CFR 1910.132(a): The employer did not ensure that protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was used and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) At Rig #16 near Stanley, ND, where, on or about 09/04/2012, employees were not required to be wearing FR clothing during rig set up and were exposed to the potential for injury and/or death when flammable vapors were ignited inside the invert mud tank creating an explosion and fire.
