OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential catastrophic release of ammonia: (a) Location - Establishment: On or about 8/31/12, employees were operating an anhydrous ammonia refrigeration system without an adequate mechanical integrity program for routine inspection and maintenance to ensure safe operation.

29 CFR 1910.178(m)(8): There was not sufficient headroom under overhead installations, lights, pipes, sprinkler system, etc. (a) Location - Frozen Storage Warehouse: On or about 8/31/12, stored materials were accessed with fork trucks. There was not sufficient head room between the stored materials and overhead piping that contained ammonia to allow for safe access.
