29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep th (a) At the front side of the building on or about September 6, 2012 and at times prior thereto, a twelve foot stepladder was placed and used in a driveway where the ladder can be displaced by traffic. A barricade was not used to keep traffic away from the ladder. Employee was exposed to a 10 feet fall to the concrete pavement below.

29 CFR 1926.1060(b): The employer did not provide retraining as necessary so that each employee exposed to fall hazards maintained the understanding and knowledge acquired through initial training: (a) At the front side of the building on or about September 6, 2012 and at times prior thereto, retraining was not provided for each employee as necessary so that the employee maintains the understanding and knowledge acquired through compliance with this section. A twelve foot stepladder was placed and used in the driveway where the ladder can be displaced by traffic.
