29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Jobsite, 227 Greene Plaza, Waynesburg, PA: On or about September 1, 2012, during construction activities, the employer did not ensure that fall protection systems/devices were used where employees were exposed to falls of up to approximately 40 to 50 feet. Employees were on a roof to mark, level and install metal studs for parapet walls and were working near the edge of the roof with no fall protection.

29 CFR 1926.503(c)(3): The employer did not provide retraining when inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicated that the employee has not retained the requisite understanding or skill required by paragraph (a) of this subsection: a) Jobsite, 227 Greene Plaza, Waynesburg, PA: On or about September 1, 2012, prior to performing construction activities, the employer did not ensure that fall protection training was provided for employees who were exposed to fall hazards of up to approximately 40 to 50 feet. Employee training on fall protection allowed them to work on the roof to mark, level and install metal studs for parapet walls with no fall protection systems/devices in use as long as they stayed at least 6 feet away from the edge of the roof.
