29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.    a)  The Dwell Luxury Apartments:  A worker was observed installing pump jack scaffold pole supports while standing on the roof of a three story multi-family residential structure under construction.  The employee was not using fall protection (PFAS, safety nets, guardrails, etc.) and was thus exposed to a fall hazard of greater than 30 feet from the roof / working surface to the ground.  Observed on or about 9/07/2012.     NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
