29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas: (a) At the front of the project site, 2 x 4 lumber with protruding nails lay within two feet of a pathway to other work areas on the ground level. The lumber was used as formwork and dismantled prior to this inspection. Employees were exposed to the hazards of nails impaling their feet.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) At the project site on or about September 10, 2012, eye protection was not worn while an employee was hammering and/or removing nails from lumber.
