29 CFR 1918.85(l): When an employee was working along an unguarded edge where a fall hazard existed, the employer did not provide fall protection meeting the requirements of 29 CFR 1918.85(k). a) Onboard M/V BELLA VIA, portside, between bays three and five: A hatch boss was exposed to a fall of approxmately eighty feet over the side of the vessel while looking onshore approxmately two feet away from of an unguarded deck edge and was not using fall protection meeting the requirements of 29 CFR 1918. b) Onboard M/V BELLA VIA, portside between bays ten and thirteen: A lasher was exposed to a fall of approxmately eighty feet over the side of the vessel while lashing containers within two feet of an unguarded deck edge and was not using fall protection meeting the requirements of 29 CFR 1918.

29 CFR 1918.100(e)(3): The employer did not review with each employee upon initial assignment those parts of the plan that the employee must know to protect the employee in the event of an emergency. a) Onboard M/V BELLAVIA: The employer failed to review the emergency action plan with employees upon initial assignment, including those parts of the plan they must know to protect themselves in the event of an emergency. A lashing boss and working onboard lashers stated the Emergency Action Plan was never discussed. SSA TERMINALS, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1918.100(E)(3) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313586794, CITATION NUMBER 01, ITEM NUMBER 01 AND WAS AFFIRMED AS A FINAL ORDER ON FEBRURARY 16, 2011 WITH RESPECT TO A WORKPLACE ONBOARD THE VESSEL MOKIHANA, LOCATED AT A TERMINAL LOCATED AT ONE MARKET STREET, OAKLAND CA.
