The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. U.S. Postal Service, Barrigada P&DC: On September 12, 2012, and at times prior thereto, maintenance employees were wearing N95 respirators for conducting work including, but not limited to sweeping, and no medical evaluation was conducted to determine the employee's ability to use a respirator.

29 CFR 1910.1200(f)(5)(ii): The employer did not ensure that appropriate hazard warnings, or alternatively, words, pictures, symbols, or combination thereof, which provide at least general information regarding the physical and health hazards of the hazardous chemical. U.S. Postal Service, Barrigada P&DC: On September 12, 2012, and at times prior thereto, the employer failed to ensure that hazard warning labels were not placed on secondary containers containing, but not limited to the following: bleach, Skilcraft clean All Purpose Cleaner, and Rite-Ken Dust Mop Treatment that were used for cleaning surfaces. Many containers were reused bottles of Windex, further limiting proper communication of the hazards.
