OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard:     On the south east exterior elevation of The Hilton Inn located at 8201 Congress Avenue in Boca Raton, Florida:  Employees performing landscaping work using a 6 ft. fiberglass step ladder to dump refuse cans into the back of a truck were exposed to the hazard of falling from that ladder while not used in the fully opened position, on or about September 11, 2012.    Among other means, one feasible means of abatement is to ensure step ladders are used for the purpose which they are designed and use only when in its fully-opened position, as required by the American National Standards Institute ANSI A14.5-1992 for Ladders-Portable Reinforced Plastic.

The Brickman Group LTD LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.133(a)(1), which was contained in OSHA inspection number 314268491, citation number 2, item number 1 and was affirmed as a final order on May 6, 2011, with respect to a workplace located at 963 Nob Hill Road in Plantation, Florida.
