29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities were not in near proximity to the worksite and were not so equipped as to enable employees to remove such substances. At the project: On or about September 11, 2012, and at times prior thereto, adequate washing facilities were not provided for employees that applied Lexis Coating Energy Max Silicone Coating to the roofs of about 35 apartment buildings. Water was provided through hoses to wash. Soap or sanitizer was not provided or available onsite. Towels or other drying methods were not provided. The material safety data sheet for the product said to wash hands before eating.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: At the project: On or about September 11, 2012, and at times prior thereto, gloves were not worn when applying Lexis Coating Energy Max Silicone Coating to the roofs of about 35 apartment buildings. Employees had the product on their hands. The material safety data sheet for the product said to wear chemical resistant gloves.
