29 CFR 1926.20(b)(1):  The employer did not initiate and maintain such programs as may be necessary to comply with this part:    Employees performing re-roofing tasks at the 3 story Twin Oaks apartment building(s) at 719 & 723, Topeka Blvd., Topeka, Kansas were exposed to fall hazards associated with roofing work such as but not limited to; eye injuries, fire hazards, fall hazards, working from scaffolds, and powered industrial trucks.  The employer did not have a safety and health program to address these hazards.    29 CFR 1903.19(c)(1):  Requires certification that the abatement of the above violation is complete.

29 CFR 1926.451(g)(1)(vii):  Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    Employees performing re-roofing tasks at the 3 story Twin Oaks apartment building(s) at 719 & 723, Topeka Blvd., Topeka, Kansas, were exposed to fall hazards exceeding 30 feet from the roof to the ground/concrete below. Employees were climbing onto and over the guardrails for the scaffold platform mounted on the 944-E42 JLG Lull All terrain forklift.    29 CFR 1903.19(c)(2): No abatement certification is required. The roofing job has been observed to be completed.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:     Employees performing re-roofing tasks at the 3 story Twin Oaks apartment building(s) at 719 & 723, Topeka Blvd., Topeka, Kansas, were exposed to fall hazards exceeding 30 feet from the roof to the ground/concrete below in that no fall protection was used.    29 CFR 1903.19(c)(2):  No abatement certification is required. The roofing job has been observed to be completed.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:    Employees performing re-roofing tasks at the 3 story Twin Oaks apartment building(s) at 719 & 723, Topeka Blvd., Topeka, Kansas, were exposed to fall hazards exceeding 30 feet from the roof to the ground/concrete below in that employees were not trained in the proper use of personal fall arrest systems and a safety monitoring system.  	  29 CFR 1903.19(c)(1):  Requires certification that the abatement of the above violation is complete.
