29 CFR 1910.110(e)(4)(iii): Permanent and removable fuel containers shall be securely mounted to prevent jarring loose, slipping, or rotating, and the fastenings shall be designed and constructed to withstand static loading in any direction equal to twice the weight of the tank and attachments when filled with fuel using a safety factor of not less than four based on the ultimate strength of the material to be used. Field welding, when necessary, shall be made only on saddle plates, lugs or brackets, originally attached to the container by the tank manufacturer. Entire facility - On or about September 19, 2012, the LP gas cylinder was not securely mounted on the TCM #655 forklift truck, in thay the one mounting latch was missing. Employees were exposed to fire and struck-by hazards.

29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. Waerehouse area - On or about September 19, 2012, certification and/or evaluation was not available to show that each and every forklift operator had been trained.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. Warehouse - On or about September 19, 2012, the following sit down forklift trucks were not kept in a safe working condition, thereby exposing employees to the hazards associated with a moving forklift truck. 1. TCM #655 - no operable horn 2. TCM #666 - lights, emergency brakes not operable, defective exhaust system & excessive worn tires 3. TCM #672 - lights not operable 4.
