Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the load should the below-the-hook lifting devices fail:    a)  Saw Area, on or about 9/20/12:  A spreader beam below-the-hook lifting device being used on a Cleveland two ton overhead crane to lift bar stock had no rated load capacity markings and had not been inspected.    b)  Mill Area, on or about 9/20/12:  A below-the-hook lifting device being used on a Cleveland two ton overhead crane for lifting parts into and out of the Mori Seiki CNC mill had no rated load capacity markings and had not been inspected.    Abatement certification must be submitted for these items.

Hartman Enterprises, Inc. was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA Inspection number 310751953, Citation 1, Item 1 and was affirmed as a final order on 12/14/07, with respect to a workplace located at 455 Elizabeth Street, Oneida, New York.
