29 CFR 1926.651(c)(2):     A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth:     a)  Rt 73 N, EveshamTwsp., NJ:  An employee was exposed to caught-in and crushing hazards while working in an unshored trench greater than 7 feet deep.  There was no ladder or other safe means of employee egress from the trench. Observed on or about 9/20/12.     NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.651(k)(2):     Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    a)  Rt 73 N, EveshamTwsp., NJ:  An employee was exposed to caught-in and crushing hazards while working in an unshored trench greater than 7 feet deep, 8 feet wide at top / approx. 4 feet wide at bottom, with nearly vertical side walls.  The excavation showed visible fissures and loose soil was sluffing down the walls.  The employee was not protected from cave-ins by adequate protective systems, shoring, sloping or benching.  The employers competent person did not remove the employee from the hazardous trench.  Observed on or about 09/20/12.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). Nor had the employer complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical.      a)  Rt 73 N, EveshamTwsp., NJ:  An employee was exposed to caught-in and crushing hazards while working in an unshored trench greater than 7 feet deep, 8 feet wide at top / approx. 4 feet wide at bottom, with nearly vertical side walls.
