29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent): On or about September 19, 2012, the employer failed to ensure open-sided floors and/or platforms four feet or more above the adjacent floor or ground level were guarded with standard railings or equivalent: (a) Near the Cleaver-Brooks boiler 1, employees used a platform during maintenance and cleaning of the boiler and were not protected from fall hazards of approximately 10 feet. (b) Near the Cleaver-Brooks boiler 2, employees used a platform during maintenance and cleaning of the boiler and were not protected from fall hazards of approximately 10 feet. (c) Near the Cleaver-Brooks boiler 3, employees used a platform during maintenance and cleaning of the boiler and were not protected from fall hazards of approximately 10 feet. (d) Near the Cleaver-Brooks boiler 4, employees used a platform during maintenance and cleaning of the boiler and were not protected from fall hazards of approximately 10 feet.

29 CFR 1910.27(c)(5): The employer failed to maintain at least 4 inches between the centerline of the grab bar and the nearest permenant object in back of the grab bar on fixed ladders: On or about September 19, 2012, employees were exposed to falls of approximately 10 feet: (a) Near the Cleaver-Brooks boiler 1, there was not at least 4 inches of clearance between the centerline of the fixed ladder's grab bar and the guard rail post on the boiler platform. (b) Near the Cleaver-Brooks boiler 2, there was not at least 4 inches of clearance between the centerline of the fixed ladder's grab bar and the guard rail post on the boiler platform. (c) Near the Cleaver-Brooks boiler 3, there was not at least 4 inches of clearance between the centerline of the fixed ladder's grab bar and the guard rail post on the boiler platform. (d) Near the Cleaver-Brooks boiler 4, there was not at least 4 inches of clearance between the centerline of the fixed ladder's grab bar and the guard rail post on the boiler platform. (a) Near the Cleaver-Brooks boiler 1, there was not at least 4 inches of clearance in the back of the fixed ladder's grab bars.
