On November 1, 2012, employees were found to be spraying highly flammable chemicals such as, but not limited to, organic peroxides and spark producing electrical equipment such as, but not limited to, light switches, fluorescent lighting, electrical conduit, electrical panels, a microwave, and exhaust fans were located in the spraying area and had not been explosion proof, approved for Class I, Group D locations.

29 CFR 1910.107(d)(2) All spraying areas were not provided with mechanical ventilation adequate to remove flammable vapors, mists, or powders to a safe location and to confine and control combustible residues so that life is not endangered. On November 1, 2012, employees were found to be spraying highly flammable chemicals such as, but not limited to, organic peroxides and no mechanical ventilation was available to remove flammable vapors and mists to a safe location so that life is not endangered. The employer had converted a large, rectangular, metal, hanger building (approx. 2000 sqft.) into the marble spray shop where employees prep sink molds by spraying them with highly flammable chemicals and the only ventilation for the area was the air conditioning vent blowing in clean air and a small, filterless, 10 inch fan located at the far end of the building, which exhausted to an outdoor area employees use as a passageway. The exhaust fan is incapable of pulling an average air velocity of 100 linear feet per minute and had no means to confine and control combustible residues.

29 CFR 1910.134(c)(1) In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable. On November 1, 2012, employees were found to be spraying organic peroxides and flammable liquids in the Marble Shop. A respiratory protection program has been in development but worksite specific procedures have yet to be complete to ensure employee safety.

On November 1, 2012, employees were found to be spraying organic peroxides and flammable liquids in the Marble Shop and employees were improperly using their respiratory protection. Employees were found using P100 cartridges when exposed to organic vapors while other employees were found to be using organic vapor cartridges when exposed to particulates signaling employees do not fully understand the limitations and capabilities of the different types of respiratory cartridges available to them.
