29 CFR 1910.178(l)(1)(i):     The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l)      On or about September 20, 2012, at the jobsite an employee was observed operating a high lift forklift truck without prior training or evaluation by a qualified person.  Employees were exposed to hazards caused by inexperienced forklift truck operator.

29 CFR 1926.452(c)(4):     End frames of tubular welded frame scaffolding were not locked together vertically by use of pins or equivalent means in areas where uplift could occur:      On or about September 20, 2012, at the jobsite materials were observed being loaded onto scaffolds by a forklift truck this may cause an uplifting condition to the scaffolds however, the frames of the scaffolds were not locked together vertically by locking pins or equivalent means.  Employees were exposed to the hazards of the scaffolds being uplifted and/or collapsed.

On or about September 20, 2012, at the jobsite employees were observed working from a fourth level of a 4-tier scaffold where the platforms were not fully planked or decked.  Employees were exposed to fall hazards of approximately 24-ft to the ground.

Employees were exposed to the hazards of the scaffolds being tipped over.
