29 CFR 1926.303(b)(1):  Grinding machines were not equipped with safety guards in conformance with the requirements of American National Standards Institute, B7.1-1970, Safety Code for the Use, Care and Protection of Abrasive Wheels, and paragraph (d) of this section:  (a) New South Stair Way, Second Floor of Gym Area Renovation - An employee used a Makita angle grinder, model 9557PB, serial number 0410795Y, equipped with a Pearl Silver Line abrasive cut-off wheel, part number CW4510T, to cut off intermediate vertical members from the metal stair railing.  This Makita angle grinder had no guard on the abrasive cut-off wheel, on or about September 21, 2012.

29 CFR 1926.602(c)(1)(vi):  Industrial trucks in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks; the load engaging means was not fully lowered when leaving a powered industrial truck unattended, and powered industrial trucks with defects or in any way unsafe had not been withdrawn from service until restored to safe operating conditions:  (a) Front of Gym Area Renovation - Employees worked from a personnel platform installed and elevated on the forks of a JCB Loadall 580-40/568108 telehandler to install a steel lintel at the top of the window wall.  The operator had dismounted the telehandler and did not have the load engaging means fully lowered, on or about September 21, 2012.  (b) Front of Gym Area Renovation - The outer covering of a hydraulic hose for raising and lowering the boom of the JCB Loadall 508-40/568108 telehandler, had deteriorated in spots, and this powered industrial truck did not get withdrawn from service for repairs, on or about September 21, 2012.

This employee wore a harness and lanyard but did not have his legs through the leg straps of the harness and did not tie off or use any other fall protection, on or about September 21, 2012.  STOLTZFUS WELDING & RENTALS, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION STANDARD OR ITS EQUIVALENT STANDARD 1926.760(a)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314238478, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON MAY 10, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 1920 TECHNOLOGY PARKWAY, MECHANICSBURG, PENNSYLVANIA  17050.
