29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: This violation occurred on September 18, 2012, at a workplace located at 6005 Corsica, Plano, TX 75024; where at least five (5) employees, who were working from rafters and trusses, were not protected from falling to the ground below.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: This violation occurred on September 18, 2012, at a workplace located at 6005 Corsica Way, Plano, TX 75024; where at least five (5) employees, who were working at various elevations under construction activities, were not protected from head injuries by wearing hard hats. RICARDO ORTIZ WAS REVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.100(a) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 316094176, CITATION NUMBER 1, ITEM NUMBER 1, ISSUED ON 02/28/2012, AND WAS AFFIRMED AS A FINAL ORDER ON 03/09/2012, WITH RESPECT TO A WORKPLACE LOCATED AT 3035 LAKE EDGE, DALLAS, TX 75230.
