29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) 35 Fifty Second Street - On or about September 27, 2012, employees pressure washing a metal roof on a two-story residential home were not protected from falling by protective equipment such as but not limited to the use of personal fall arrest systems, exposing employees to fall hazards from about 25 feet onto earthen ground. OR IN THE ALTERNATIVE 29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) 35 Fifty Second Street - On or about September 27, 2012, employees pressure washing a metal roof on a two-story residential home were not protected from falling by the use of a guardrail system, safety net system, personal fall arrest systems, and the employer did not implement a fall protection plan as to why conventional fall protection was infeasible or created a greater hazard, exposing employees to fall hazards from about 25 feet onto earthen ground.
