OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards:    a)  On or about 9/27/12 - Plant area, the Nissan 90 diesel forklift, Model# WGF034A40V, Serial# WGF03920645 was operated without a seat belt.    b)  On or about 9/27/12 - Plant area, the Nissan Optimum 50 LPG forklift was operated without a seat belt.        Among the other methods, one feasible and acceptable method to correct this hazard is to ensure that seat blets are provided and utilized, as stated in ASME B56.1b-2003, Standard for Low Lift and High Lift Trucks, Section 7.41, Operator Restraint Systems.
