OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire, explosion and deflagration, or other fire hazards from a lack of fire protection system, a lack of an inspection and maintenance program and training of employees where dust collector systems operated inside a building: Polycel Structural Foam, Sanding Room: 1) Torit MFG, SN# 376 Dust collection systems #1, 2) Dust collector #2 with Allen Bradley electrical control panel on or about September 28, 2012, were not provided with the following, but not limited to: A) Fire protection system Among other methods, one feasible and acceptable abatement method to correct these hazards is to comply with relevant provisions in NFPA 654 (2006) Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids, such as: Section 7.12.3 requires that where fire hazards exists and where combustible particulate solids pass through an air-moving device, provisions shall be made to prevent ignited material from entering processes downstream in accordance with Chapter 10. B) Comprehensive inspection and maintenance program. Among other methods, one feasible and acceptable abatement method to correct these hazards is to comply with relevant provisions in NFPA 654 (2006) Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids, such as: Section 12.1.2 requires that an inspection, testing, and maintenance program be developed and implemented to ensure that the fire and explosion protection systems and related process controls and equipment perform as designed and Section 12.1.3 Requires that records be kept of maintenance and repairs performed. C) Initial and refresher training. Among other methods, one feasible and acceptable abatement method to correct these hazards is to comply with relevant provisions in NFPA 654 (2006) Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids, such as: Section 11.3.1 requires that an initial and refresher training be provided to employees who are involved in operating, maintaining, and supervising facilities that handle combustible particulate solids.

Means were not provided to prevent a fire/explosion hazard, in that, the machinery/equipment and/or wiring used in the Class II combustible locations were not approved for the Class II Division II locations among electrical machinery/equipment/wiring used, but not limited to: 1/Dust Collection System #1 (Torit MFG, SN# 376) and 2/Dust Collection System #2 (dust collector with Allen Bradley electrical control panel).
