29 CFR 1910.23(b)(1): 23(b)(1): Every wall opening from which there is a drop of more than 4 feet was not guarded. The employer does not ensure that every wall opening from which there is a drop of more than 4 feet are guarded. On or about October 1, 2012, and times prior thereto, employees working throughout the facility were exposed to fall hazards of more than 4 feet while working near loading dock wall openings that were not in use and were not guarded with guardrails or an equivalent fall protection measure allowed by this standard. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that wall openings from which there is a drop of more than 4 feet are guarded by a standard guardrail system or by an equivalent fall protection measure required by 29 CFR 1910.23(b).
