On or about October 1, 2012, the employer did not ensure that no other employees except employees receiving a 20 foot steel tube being lifted from one side of a building wall to the other side were in the fall zone exposing employees to a crushed-by hazard.

29 CFR 1926.1433(d)(7)(iii)(C): Windows introduced visible distortion or otherwise obscure visibility that interfered with the safe operation of the equipment. On or about October 1, 2012, and at times prior there to, the employer did not ensure the windows in the cab had no obscured visibility interfering with the safe operation of the equipment exposing employees to crushed-by hazards: a. The front window of the cab of a crane was cracked on the upper left section and obscured the visibility of the operator while hoisting a load over the wall of a building being built. b. The left side window of the cab of a crane was completely cracked and obscured the visibility of the operator while hoisting a load over the wall of a building being built.
