29 CFR 1910.178(q)(1): Power-operated industrial truck not in safe operating condition was not taken out of service. The employer does not ensure that every forklift in unsafe operating condition had been removed from service until repairs could be made. Instance a: This condition was observed on or about October 01, 2012 at the facility where employees were exposed to a struck-by hazard while operating a Nissan forklift (unit 24) with tires in unsafe operating conditions. Instance b: This condition was observed on or about October 01, 2012 at the facility where employees were exposed to a struck-by hazard while operating a Yale forklift (unit 11020) with forks in unsafe operating conditions. Instance c: This condition was observed on or about October 01, 2012 at the facility where employees were exposed to a struck-by hazard while operating a Nissan forklift (unit 10054) with forks in unsafe operating conditions. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that every forklift in unsafe operating condition are removed from service until repairs could be made.
