29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about October 4, 2012, Desert Springs Unit #1, Trans-Mountain & Northwestern Dr. (North side of Highway): three employees were observed working in a trench at the east end 105-feet away from of the nearest egress/exit point. The trench was approximately 124-feet long, 6-feet wide at the east end, 9-feet wide at the west end and 8-feet deep. The employees were exposed to entrapment and/or cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal): On or about October 4, 2012, at Desert Springs Unit #1, Trans-Mountain & Northwestern Dr. (North side of Highway); three employees were observed working at the east end of the trench approximately 124-feet long, 6-feet wide, 5-feet 6-inches deep at the east end and 9-feet wide, 6-feet 3-inches deep at the west end. Employees in the trench were not protected from cave-ins by an adequate protective system such as a trench box. The employees were exposed to entrapment and/or cave-in hazards. EL PASO UNDERGROUND CONSTRUCTION INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652 (A)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 307250209, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON MAY 09, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT DESERT OCOTILLO, HORIZON CITY, TX 79903.
