29 CFR 1926.651(e): Employee was not prohibited to be underneath loads handled by lifting or digging equipment: On or about October 4, 2012, at Eastlake & Rojas Eastside Development, an employee was observed underneath a suspended precast concrete drain pipe weighing 4520 pounds being lowered into the trench by a Takeuchi TB1140 hydraulic excavator. The employee was exposed to crushed-by and struck-by hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal): On or about October 4, 2012, at the Eastlake & Rojas Eastside Development, two employees were observed working in a trench approximately 250 feet long by 15 feet wide and 7 feet 8-inches deep. Employees in the trench were not protected from cave-ins by an adequate protective system such as a trench box and were exposed to entrapment and/or cave-in hazards. EL PASO UNDERGROUND CONSTRUCTION INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652 (A)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 307250209, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON MAY 09, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT DESERT OCOTILLO, HORIZON CITY, TX 79903.
