29 CFR 1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:        (a)  On or about 10/10/2012, on the south end of the building, an employee who was not wearing a protective helmet was working on the second level of the scaffold while an employee worked on the level above him.  The employee on the second level was exposed to being struck by falling or flying objects.

29 CFR 1926.451(e)(1):  When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.        (a)  On or about 10/10/12, on the south end of the building, employees were not provided with a ladder to use to access the scaffold.  They accessed the scaffold platforms by climbing the end frames.  Employees were exposed to fall hazards of up to approximately 18 feet to the concrete below.

29 CFR 1926.451(g)(4)(i):  Guardrail systems were not installed along all open sides and ends of platforms.      (a)  On or about 10/10/12, on the south end of the building, employees were on the scaffold to perform masonry work where there were no guardrails installed along the ends of the platforms.  The employees were exposed to fall hazards of up to approximately 18 feet to the concrete below.

29 CFR 1926.451(h)(1):   Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.      (a)  On or about 10/10/12, on the south end of the building, employees working on lower levels of the scaffold or at the ground level were not protected from falling objects through the installation of toeboards or other devices to contain or deflect falling objects.  Employees were exposed to the hazard of being struck by falling objects.

(a)  On or about 10/10/12, on the south end of the building, an employee was standing on a stack of EIFS in order to reach the highest point of the wall.  The employee was exposed to fall hazards of approximately 18 feet to the concrete below.

Employees were exposed to fall hazards of up to approximately 18 feet to the concrete below in the event of scaffold collapse.
