29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: On the west edge of the canopy in front of a Race Trac service station under construction located at 4201 SE Federal Highway in Stuart, Florida: Employees preparing to perform electrical work from the basket of an aerial lift approximately 22 ft. 6 inches above a lower level were not wearing a safety harness with a lanyard attached to the boom or basket of that lift and having the access gate/guardrail held completely opened, on or about October 10, 2012.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: On site of a Race Trac service station under construction located at 4201 SE Federal Highway in Stuart, Florida: The employer did not provide a training program for each employee performing work on an aerial lift for them to recognize the hazards of falling, on or about October 10, 2012. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
