29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform.  The endpoints at each upright were more than 48 inches (1.3 m) apart.    (a) Cooper Plaza, Route 73 S. Voorhees, NJ, North Side of Structure: Cross bracing used on the scaffold was at an acceptable height to be used as a midrail; however there was no top rail. Observed on or about 10/10/12. 29 CFR 1926.454(c): The employer had reason to believe that an employee lacked the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, and the employer did not retrain such employee so that the requisite proficiency was regained:    (a) Cooper Plaza, Route 73 S. Voorhees, NJ, North Side of Structure: Employees were working from a fabricated frame scaffold with numerous hazard conditions and did not recognize them, such as: lack of proper access, lack of proper toeboards where needed, lack of fall protection, improper use of guard rails.  Noted on or about 10/10/2012. Voorhees, NJ, North Side of Structure: A ladder or other proper means was not provided for employees to use to access the third level of the scaffold (approximate 22 foot fall to ground).
