OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of falls when walking/working on top of railcars, or rolling stock: On or about Tuesday November 13, 2012 outside and in front of the repair facility: An employee was observed outside the facility walking on top of several railcars, and/or rolling stock inspecting the condition of the cars without being tied off at about 15 feet from the ground level. Among other methods, one feasible and acceptable means of abatement include, but not limited, to: Consult with manufacturers of the railcars and rolling stock to determine what fall protection equipment is able to be used by the employees walking/working on top of the railcars and rolling stock.

29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening: Employees working at the lower blasting pit were exposed to a fall hazard of up to eight feet where a midrail was not installed.
