29 CFR 1910.95(c)(1):     The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    The employer did not establish and implement a hearing conservation program for employees exposed to noise at or above 85 decibels in that:    a) The employer did not implement a monitoring prgram to identify employees for inclusion in the hearing conservation program;    b)  The employer did not establish a baseline audiogram within 6 months of an employee's first exposure at or above the action level of 85 decibels;    c) The employer did not ensure that employees exposed to noise at or above 85 decibels wore hearing protection until a baseline was established;    d) The employer did not provide a variety of hearing protection and ensure hearing protection was worn by employees exposed to noise at or above 90 decibels;    e) The employer did not institute a training program for all employees who are exposed to noise at or above an 8-hour time weighted average of 85 decibels;    f) The employer did not ensure that a copy of the noise standard was available to affected employees and a copy was posted in the workplace.    On or about October 24, 2012, the Cuber Operator was exposed to noise at a time weighted average of 89.4 decibels, the Utility man at 88.6 decibels, the Mixer Helper at 95.1 decibels and the inside Forklift Operator at 93.7 decibels .

29 CFR 1910.1200(h)(1):     The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment which must include:    a) the requirements of 29 CFR 1910.1200;  b. operations where hazardous chemicals are present;  c. location and availability of the written hazard communication program and material safety data sheets;  d. physical and chemical hazards of chemicals in the work area;  e. methods to detect the presence of hazardous chemicals in the work area;  f) measures to protect against hazards of the chemicals in the work area;    The employer did not provide training in accordance with the Hazard Communication Standard, employees were exposed to chemicals such as but not limited to sand (silicosis), portland cement (caustic) and limestone (silicosis).
