29 CFR 1926.600(a)(3)(i): Bulldozer and scraper blades, end-loader buckets, dump bodies, or similar equipment were not fully lowered or blocked when being repaired or when not in use: (a) At the project site, on or about October 17, 2012 and at times prior thereto, the outriggers of the Terex 760 end-loader, serial number 02192009, were not either fully lowered or blocked when not in use. An employee was observed walking within two feet of the raised outrigger was exposed to the hazard of being struck-by the outrigger.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage which could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. a. At the project site, on or about October 17, 2012 and at times prior thereto, the tire (drivers side, front) of the Terex 760, serial number 02192009, was worn and lights (hazard & signal) were inoperative. Employees working in the vicinity were exposed to struck-by hazards.
