29 CFR 1926.95(a):  Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    (a) At 6 Flag Circle, Piti, Guam on or about October 19, 2012, and at times prior thereto, gloves were not worn when Speedhide 6-903XI paint, was applied onto the exterior wall.  The MSDS recommended the use of PVA, NEOPRENE RUBBER OR LATEX RUBBER GLOVES.  There was paint on the employee's hands.

29 CFR 1910.1200(e)(1)(i):  The written hazard communication program did not include a list of the hazardous chemicals known to be present, using an identity that was referenced on the appropriate material safety data sheet:    (a) At 6 Flag Circle on or about October 19, 2012 and at times prior thereto, the employer failed to list the names of all hazardous chemicals used in the workplace by using the identity that is referenced on the material safety data sheet (MSDS). This identity is often a common name, such as the product or trade name (i.e., Lime-A-Way). An inventory list identifying Speedhide 6-903XI paint, PPG Sun Proof Exterior 23717 was not available.

29 CFR 1910.1200(g)(8):  The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift:    (a) At 6 Flag Circle on or about October 19, 2012 and at times prior thereto, there was no material safety data sheets for Speedhide 6-903XI paint.  Employee applied the paint onto exterior walls using a spray application.
