29 CFR 1910.106(h)(4)(iv)(a): Equipment was not designed and arranged to prevent the unintentional escape of liquids and vapors and to minimize the quantity escaping in the event of accidental release: On or about October 9th, 2012, the batch mixer was not designed to prevent the release of flammable vapors. The sand heater door, located on the top, did not have a sufficient sand seal which allowed the vapors to reach the sand heater's flame on the next level, the vapors ignited and exited the batch mixer through the door located on the east side of the mixer.

29 CFR 1910.106(h)(4)(iv)(b): Where the vapor space of equipment is usually within the flammable range, the probability of explosion damage to equipment was not limited by inerting, by providing an explosion suppression system, or by designing the equipment to contain the peak explosion pressure which may be modified by explosion relief: On or about October 9th, 2012, and at times prior thereto, the employer did not ensure that the batch mixer used to heat and bond resins to sand was equipped with an adequate explosion control system, exposing employees operating and working near the batch mixer to the hazard of fire and explosion.
