29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user Location: 1 Harborside Drive, Logan International Airport, East Boston, MA The employer did not ensure that the laborers who were resportedly voluntarily wearing elastomeric half-mask negative pressure respirators received a medical evaluation to ensure that they were medically able to wear the respirator.

29 CFR 1910.134(k): The employer did not provide comprehensive, understandable training which did not occur annually and/or more often if necessary: Location: Logan International Airport, 1 Harborside Drive, East Boston, MA The employees, both those wearing N95 respirators and those wearing elastomeric half-mask negative pressure respirators, were not trained annually on the purpose of their respirators, how to inspect, maintain, and use their respirators, and how to recognize medical signs that may limit the effectiveness of their respirators or endanger the health of the employees. Employees who were voluntarily wearing N95 respirators were not provided with copies of Appendix D of 29 CFR 1910.134.
