29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) On or about October 16, 2012, Facilities Contracting Inc., as controlling employer, did not ensure that employees of TP Enterprises, Inc., subcontractor, were protected from fall hazards of 13.9 feet at the west end of a scaffold on the south side of the building, which was erected beyond the end of the building, where guardrails were missing and the employees were working. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about October 16, 2012, Facilities Contracting Inc., as controlling employer, did not ensure that an employee of TP Enterprises, Inc., subcontractor, was protected from fall hazards from the roof of the building that he accessed from scaffold to stucco the walls, that was approximately 7 feet above the next lower scaffold level and 21 feet above the ground, and had no fall protection system. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
