29 CFR 1926.451(d)(16): In addition to the normal operating brake, suspension scaffold power-operated hoists and manually operated hoists shall have a braking device or locking pawl which engages automatically when a hoist makes either of the following uncontrolled movements: an instantaneous change in momentum or an accelerated overspeed. a. On or about October 22, 2012 - at the above addressed jobsite, employees performing tuckpointing operations from two point suspended scaffolds, approximately twenty (20) feet above the ground, were not provided with a breaking device or locking pawl which engages automatically following an uncontrolled movement, thereby exposing the employees to falls. THE TOP NOTCH MASONRY, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.451(d)(16) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313935769, CITATION NUMBER 1, ITEM NUMBER 2e AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 4, 2010 WITH RESPECT TO A WORKPLACE LOCATED AT 2600 S. On or about October 22, 2012 - at the above addressed jobsite, employees were performing tuckpointing operations from two point suspended scaffolds approximately twenty (20) feet above the ground. 29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: a. On or about October 22, 2012 - at the above addressed jobsite, employees using two point suspended scaffolds were not trained to recognize the hazards associated with the use of such scaffolds, thereby exposing the employees to the hazards associated with falls.
