29 CFR 1910.303(a) The conductors and equipment required or permitted by this subpart were not acceptable, as defined in Sec. 1910.399.    It was found on October 12, 2012, the employer designed, produced, and installed unapproved equipment.  A device called the Smart Box 3 was not approved by a Nationally Recognized Testing Laboratory and was not tested and examined for workplace safety, nor was the Smart Box 3 determined to be safe on the basis of test data.  Subsequently, the completed device design did not account for a reverse polarity wiring occurring when the Smart Box 3 casing was created.

29 CFR 1910.304(a)(2) A grounded conductor was attached to a terminal or lead so as to reverse designated polarity.    It was found on October 12, 2012, the employer designed, produced, and installed unapproved equipment.  Through the development and manufacturing process of the Smart Box 3, the design of the casing for the smart box did not account for the power boot to be turned 180 degrees on the vertical, resulting in switching the neutral and hot conductors for the system.  No safety testing had been done once a complete Smart Box 3 unit was created to determine if the completed, end user piece of equipment would be safe for employees to use.

29 CFR 1910.304(g)(5) The path to ground from circuits, equipment, and enclosures were not effective.    It was found on October 12, 2012, the grounding path from the receivers to the Smart Box to the Smart Tree was not effective exposing employees to a shock hazard.

29 CFR 1910.305(g)(2)(ii)  Flexible cords were not used in continuous lengths or without splices or taps.     It was found on October 12, 2012, the employer had attempted to correct a reverse polarity wiring of their Smart Box 3 equipment by splicing the flexible cord used to power the equipment, reversing the conductors to eliminate the reversed polarity, then securing the conductors together with electrical wing nuts, then using red electrical tape to insulate the wiring.

29 CFR 1910.334(a)(3)(iii)  Adapters which interrupt the continuity of the equipment grounding connection may not be used.    It was found on November 6, 2012, the employer had installed 3-2 adapter on electrical outlets which employees use to plug in receivers to be tested.  The adaptor does not have a grounding pin and is instead equipped with a grounding screw tab which is to be screwed into the wall plate, center screw of the outlet.  During the walk around several adaptors were observed to have their grounding tab severely damaged, some completely uninstalled from the screw plate.
