29 CFR 1926.28(a):     The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.    (a)  On October 26, 2012, or at times prior thereto, the employer failed to ensure the use of seatbelts when operating a John Deere 410J Backhoe, Product ID 1T0410JXJA0192032.      Seatbelts are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a accident, and that the failure to wear the seat belts that are provided in the backhoe increases the risk of injury to the operator in the event of an accident.

29 CFR 1926.300(b)(1):  Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use:    (a)  At the project site on October 26, 2012, and at times prior thereto, a Makita 4-1/2" Paddle Switch Angle Grinder, Model: 9557PB, was used to etch concrete.  The grinder was missing its guard thus, exposing operator to exposed moving parts.

29 CFR 1926.600(a)(3)(i):  Bulldozer and scraper blades, end-loader buckets, dump bodies, or similar equipment were not fully lowered or blocked when being repaired or when not in use:    (a)  At the project site on October 26, 2012, or at times prior thereto, the rear end-loader bucket, and outriggers on the John Deere 410J Backhoe, Product ID 1T0410JXJA0192032 were not either fully lowered or blocked when not in use.
