(a)  On October 26, 2012, or at times prior thereto, the employer failed to ensure the use of seatbelts when operating a John Deere 410J Backhoe, Product ID 1T0410JXJA0192032.      Seatbelts are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a accident, and that the failure to wear the seat belts that are provided in the backhoe increases the risk of injury to the operator in the event of an accident.
